International extradition is the formal process by which an individual
is delivered from a country where he or she is located to the requesting country
in order to face prosecution or serve a sentence. The parties involved in an
extradition are the two countries and the individual who is the subject of the
proceedings.
Generally, under federal law 18 U.S.C. § 3184, extradition may be granted only
where there is a treaty present addressing extradition. Some countries grant
extradition without a treaty. Further, the 1996 amendments to 18 U.S.C. §§ 3181
and 3184 permit the United States to extradite, without regard to the existence
of a treaty, persons (other than citizens, nationals or permanent residents of
the United States), who have committed crimes of violence against nationals of
the United States in foreign countries.
Most countries deny extradition requests if, in the government’s opinion, the
suspect is sought for a political crime. Many countries, such as Mexico, Canada
and most European nations, will not allow extradition if the death penalty may
be imposed on the suspect, unless they are assured that the death sentence will
not subsequently be passed or carried out.
