Alleged federal criminals do not immediately proceed to a criminal trial in the United States. Instead, their case is investigated by a federal grand jury, which looks at evidence and calls witnesses before indicting the suspect or dropping the case altogether. The U.S. Attorney General presents a case and the jury decides by majority vote whether it should proceed to court after investigating the evidence.

A federal grand jury is comprised of citizens who are selected through voter and driver registration lists; they can serve to a maximum of 36 months depending on the nature of the grand jury. The grand jury procedure is different from a normal criminal proceeding; there is no judge and there are no attorneys other than the prosecuting attorney. Witnesses may be represented by their own attorney, but the attorney is not allowed in the grand jury room. He or she must wait outside while their client testifies. Witnesses may, however, step outside to ask their attorney a question. Grand juries can subpoena records and/or call witnesses and grand jury deliberations are conducted in secret.
