Credit Card Fraud

Counterfeiting credit cards, using lost or stolen cards, and fraudulently acquiring credit cards through the mail are all common types of credit card fraud. One form that is notably on the rise is “misappropriation,” the crime of using the credit card number by itself to make purchases. All such laws are investigated and prosecuted primarily under the jurisdiction of the U.S. Secret Service, though other state and federal law enforcement agencies can pursue a case.

Title 18, §1029 of the U.S. Code explains the violations and penalties associated with credit card fraud, which falls into the legal category of “fraud and related activities in connection with access devices.” Access devices are the things that allow access to account funds — anything from credit cards themselves to telecommunications equipment to PIN codes to counterfeit cards. More than half of the credit card fraud that goes on today takes place through a very familiar access device — the computer.
