Counterfeiting

South Florida Federal Criminal Defense Attorney, David J. Joffe focuses on criminal defense of persons accused of white collar crimes, including counterfeiting. David J. Joffe has personally handled over 300 Federal cases. Call today for a confidential consultation.

Counterfeiting is a specific form of forgery, typically, the creation of forged versions of money, bonds, or other valuable instruments and obligations. Beyond simply the possession of the forged document (or means to create it), to be guilty of counterfeiting, a person must intend to deceive or defraud.

There are many different specific crimes that fall into the category of counterfeiting. It is a Class B felony, for example, to even possess paper that closely resembles that used by the Treasury to print money. Title 18 of the U.S. Code, Chapter 25, covers the specific regulations regarding crimes as diverse as forging military discharges (§498) and changing the VIN on your car (§512).

The U.S. Secret Service has direct jurisdiction for investigating and enforcing cases of counterfeiting United States obligations and securities. The agency’s Financial Crimes Division also investigates the forgery of government bonds and checks, as well as other forms of bank fraud.

Often, individuals are accused of counterfeiting when they had no idea that the currency or other instrument in their possession was forged. If this happens to you, you might face multiple charges, including conspiracy. A competent, experienced attorney can limit the charges, mitigate the sentence, and provide the best opportunity to perhaps have charges dropped altogether.
