Counterfeiting is a specific form of forgery, typically, the creation of
forged versions of money, bonds, or other valuable instruments and obligations.
Beyond simply the possession of the forged document (or means to create it), to
be guilty of counterfeiting, a person must intend to deceive or defraud.
There are many different specific crimes that fall into the category of
counterfeiting. It is a Class B felony, for example, to even possess paper that
closely resembles that used by the Treasury to print money. Title 18 of the U.S.
Code, Chapter 25, covers the specific regulations regarding crimes as diverse as
forging military discharges (§498) and changing the VIN on your car (§512).
The U.S. Secret Service has direct jurisdiction for investigating and enforcing
cases of counterfeiting United States obligations and securities. The agency’s
Financial Crimes Division also investigates the forgery of government bonds and
checks, as well as other forms of bank fraud.
